As part of our services, we may communicate with you via SMS text messages. By providing verbal consent during a phone call or by submitting your phone number through our website, you agree to receive text messages from Cascade Web Design.

Message frequency varies based on your engagement with our services. Standard message and data rates may apply depending on your carrier and plan.

Mockup previews are provided for demonstration purposes only. Mockup designs remain the intellectual property of Cascade Web Design until full payment of the setup fee is received.
Upon full payment of the one-time setup fee, ownership of the custom website design transfers to you, the client. This includes all custom HTML, CSS, images (excluding stock photography), and content created specifically for your project.
You may not reproduce, distribute, or use mockup previews for any purpose other than evaluating our services without our prior written consent.
Stock photography, third-party fonts, and open-source libraries used in your website remain subject to their respective license terms.
By engaging our services, you agree to:
We make commercially reasonable efforts to maintain website availability and performance. However, we do not guarantee 100% uptime and are not liable for service interruptions caused by factors beyond our control, including but not limited to server outages, natural disasters, cyberattacks, or third-party service failures.
Scheduled maintenance will be communicated in advance when possible.
To the fullest extent permitted by law, Cascade Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services.
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to Cascade Web Design in the twelve (12) months preceding the claim.
Mockup previews are provided "as is" for demonstration purposes and do not constitute a guarantee of final deliverables.
You agree to indemnify, defend, and hold harmless Cascade Web Design, its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your breach of these Terms, or any content you provide for your website.
Either party may terminate the service relationship at any time with 30 days' written notice. Upon termination:
We reserve the right to suspend or terminate services immediately if you breach these Terms or engage in conduct that is harmful, fraudulent, or illegal.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of such courts.
We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated effective date. Continued use of our services after any modifications constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cascade Web Design regarding the use of our services and supersede any prior agreements or communications.
